Terms of service

These terms are an agreement between you and Azan, the individual developer who makes Dam ("I", "me"). They cover the Dam iPhone app and the website dam.byazan.com. By downloading or using Dam, you agree to them. If you don't agree, please don't use the app.
What Dam is
Dam is a personal planner. It lets you build checklists, schedule them across your week, and set reminders and alarms for individual items.
Dam is not medical advice
Dam is not a medical device. It does not diagnose, treat, cure or manage ADHD or any other condition. Medication reminders in Dam are reminders only; Dam gives no advice about what to take, how much or when. Follow the instructions of your doctor or pharmacist.
Don't rely on Dam for anything critical
Alarms and notifications depend on your iPhone and on iOS. They may not arrive if your phone is off, out of battery, restarted, or if permissions are turned off, and iOS limits how many alarms an app can schedule. I work to make Dam reliable, but I can't promise that every reminder will ring. Do not use Dam as your only reminder for anything where a missed alarm could cause harm, such as time-critical medication.
Your content
Everything you enter into Dam belongs to you and stays on your device. You are responsible for keeping your own backups. Deleting the app deletes your data.
Dam Pro: subscriptions and purchases
- Dam is free to download and comes with a 7-day free trial of everything in it. The trial is run by the app: it needs no purchase, and nothing is charged when it ends.
- After the trial, a Dam Pro plan is needed to keep using the app: a weekly, monthly or yearly subscription, or a one-time lifetime purchase. Current prices are shown in the app before you buy.
- Payment is charged to your Apple account when you confirm the purchase.
- Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- You can manage or cancel a subscription in your iPhone's Settings, under your name, then Subscriptions. Deleting the app does not cancel a subscription.
- If a subscription ends, the app waits behind the plans screen until a plan is active again, and alarms do not ring in the meantime. Nothing you created is deleted.
- Purchases are handled by Apple, so refunds are decided by Apple. You can request one at reportaproblem.apple.com.
- Prices, the length of the trial and the features included may change in future. A price change for a subscription will not apply to you without the notice Apple requires.
Using Dam fairly
You may use Dam for your own personal, non-commercial purposes on Apple devices you own or control, as Apple's App Store rules allow. Please don't copy, resell, reverse engineer or tamper with the app, or use it to break the law.
Ownership
The Dam app, name, logo, character and design belong to me. These terms give you a licence to use the app, not ownership of it.
Changes to the app
I may add, change or remove features, and I may stop offering Dam. If I end a paid feature you have bought, I will try to give reasonable notice in the app or on this website.
No warranty
Dam is provided "as is" and "as available". To the extent the law allows, I make no warranties of any kind, including that the app will be uninterrupted, error-free or fit for a particular purpose.
Limit of liability
To the extent the law allows, I am not liable for indirect or consequential losses, or for any loss caused by a missed, late or silent reminder. My total liability for any claim about Dam is limited to the amount you paid for Dam in the 12 months before the claim. Nothing in these terms limits rights you have under consumer law that cannot be limited.
Apple
These terms are between you and me, not Apple. Apple is not responsible for Dam or its content and has no obligation to provide support for it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. Your use of Dam must also follow Apple's App Store terms.
Governing law
These terms are governed by the laws of Pakistan, without affecting any consumer protections you have where you live.
Changes to these terms
If these terms change, the new version will be posted on this page with a new date. Continuing to use Dam after a change means you accept the updated terms.
